MARCUS THEATRES 2010 YOU PICK THE OSCARS® CONTEST OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN,
NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING

 

1. NO PURCHASE NECESSARY TO ENTER.  Contest begins at 8AM Central Time on February 26, 2010 and ends at 5PM  Central Time on March 7, 2010.  The contest is sponsored by Marcus Theatres Corporation and its affiliated companies (herein referred to as the “Sponsor”). The Sponsor, including all of its respective agents, affiliates, subsidiaries, parent companies, advertising and promotion agencies, employees, officers, directors, and shareholders, shall be referred to collectively as the “Contest Entities”.
2. HOW TO ENTER: There is no charge or cost to register or enter. Visit the Sponsor’s website and fill in all the required fields on the official entry form available at www.marcustheatres.com (“Web Site”). Only one entry per e-mail address allowed.  The Sponsor and its respective agents are not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail, for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions, which may limit a user’s ability to participate in or enter the Contest. All notifications in the Contest will be sent by e-mail.  The Sponsor is not responsible, and may disqualify you, if your e-mail address does not work or if it is changed without prior notice to us via e-mail. Sponsor reserves the right to cancel or modify the Contest, if fraud or technical failures destroy the integrity of the Contest as determined by Sponsor, in its sole discretion.

3. ELIGIBILITY: Limit one entry per eligible person.  If you enter more than once, only your first entry received will count, and any subsequent entries will be disqualified.  All entrants must be age 13 or older at the time of entry.  All entries become the exclusive property of the Sponsor. Neither the Sponsor nor any of its respective parents, subsidiaries and/or affiliates, nor any Internet access providers are responsible for incorrect or inaccurate entry of entry information, human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone or other network, computer equipment, software or any combination thereof, inability to access the Sponsor’s website. This Contest is open only to individual legal residents of Wisconsin, Illinois, Iowa, Minnesota, North Dakota, Nebraska and Ohio.  No employees, immediate family members of employees (spouses and parents, siblings, children and their respective spouses), and/or any individuals living in the same household of employees of the Sponsor (including all affiliates, subsidiaries, parent companies and advertising agencies) are eligible to participate in this Contest.  The Sponsor reserves the right, in its sole discretion, to disqualify any individual found tampering with the entry process or entry materials.

4. SELECTION OF WINNERS: Winners will be drawn from all eligible entries that correctly select the winners as announced during the Academy Awards on March 7th, 2010 in each of the 24 categories on Sponsor’s online entry form. The entry with the most correct selections will be awarded the Grand Prize. The entries with the second, third, fourth, fifth and sixth most correct selections will be awarded a Runner-Up Prize.  In the case of multiple entries having the same number of correct selections, or no entries having all correct selections, the winners for each prize will be chosen in a random drawing of all entries that have the same number of correct selections.  Winners will be selected on or about March 8, 2010 by representatives of the Sponsor, whose decisions are final on all matters relating to this Contest. The winners will be notified by email.  If unable to contact potential winner by email, or if potential winner fails to respond to the prize notification within 48 hours after its issuance, or if any winner fails to comply with any of the Contest requirements, an alternate winner shall be selected by the Sponsor. One winner per email address. Odds of winning depend upon the number of eligible entries received.  In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be awarded to the authorized account holder of the e-mail address submitted at time of entry.   Proof of submitting entry will not be deemed receipt of such entry by Sponsor.
5. PRIZES:  All prizes listed below are subject to certain restrictions and qualifications of the Contest Entities.  Prizes (and/or any portion thereof) are nontransferable and non-exchangeable.  No substitutions or cash redemption of prizes are permitted except that Sponsor and the Contest Entities retain the right to substitute a prize of equal or greater retail value, or at Sponsor’s election, the cash value of the applicable prize.  Additional restrictions may apply.  Limit one prize per person or email address.  All federal, state and local taxes on the prize are the sole responsibility of the winner.  All prizes must be redeemed within twelve (12) months from the date issued to winner.

Grand Prize:  One (1) Grand Prize will be awarded consisting of an Annual Pass to Marcus Theatres for winner and one (1) guest.   Approximate Retail Value of $520.00.  Actual Retail Value may vary depending on the number of times the Annual Pass is redeemed.  Pass is not valid on Saturdays or for movies that are pass list suspended.

Runner-Up Prizes:  Five (5) Runner-Up Prizes will be awarded.  Each Runner-Up Prize consists of two (2) movie passes and two (2) complimentary popcorn coupons.  Approximate Retail Value of each Consolation Prize is $29.50.  Passes are not valid on Saturdays or for movies that are pass list suspended.

6.  CONDITIONS, DISCLAIMERS AND LICENSE.   ALL ENTRANTS ACCEPT THE CONDITIONS STATED IN THESE OFFICIAL RULES, AGREE TO BE BOUND BY THE DECISIONS OF THE SPONSOR, WARRANT THAT THEY ARE ELIGIBLE TO PARTICIPATE IN THIS CONTEST AND RELEASE THE CONTEST ENTITIES AND ALL OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AND SHAREHOLDERS FROM AND AGAINST ANY/AND ALL CLAIMS AND DAMAGES ARISING IN CONNECTION WITH THEIR PARTICIPATION AND/OR ENTRY IN THE CONTEST AND/OR AWARDING OR USE OF ANY PRIZE AWARDED IN THIS CONTEST. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR AND ITS DESIGNEES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.   This Contest is governed by U.S. law and is subject to all applicable federal, state and local laws.  Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction in the State of Wisconsin.  Void where prohibited by law and outside the U.S.  If, in the Sponsor’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right to void suspect entries and/or terminate the Contest and conduct a random drawing to award the prize using all eligible entries received as of the termination date.  Inclusion in such drawing will be each entrant’s sole and exclusive remedy under such circumstances.  Should the Contest be terminated prior to the stated expiration date, the Sponsor will endeavor to post notice of termination on the Sponsor’s website.

7.  Release and Indemnification:  BY ENTERING THE CONTEST, ENTRANTS RELEASE AND HOLD THE SPONSOR AND SWEEPSTAKES ENTITIES HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHT, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE CONTEST OR PARITICIPATION IN ANY CONTEST RELATED ACTIVITY, INCLUDING WITHOUT LIMITATION, ACCESS TO ANY MATERIALS,OR RESULTING DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.

8.  Miscellaneous:

  1. Dates and Deadlines:  Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest.
  2. Privacy:  Information submitted in connection with the Contest will be treated in accordance with the Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently located at
    http://www.marcustheatres.com/privacy/ ; provided, that in the event of any conflict between the Official Rules and such Privacy Policy, the terms and conditions of the Official Rules shall prevail.  By entering this Contest, entrant agrees that Sponsor may share entrant’s personal information with the Contest Entities for the purpose of prize fulfillment in the event entrant is chosen as a potential winner.  Additionally, if an entrant chooses to opt-in to a specific offer from a participating Contest Entity, entrant’s personal information will be subject to that Contest Entity’s privacy policy and terms of service (if applicable) and such entrant agrees to receive email communication from that Contest Entity.  Opting in to specific offers does not improve an entrant’s changes of winning. 
  3. Severability, Headings:  If any provision of the Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Official Rules and shall not affect t he validity and enforceability of any remaining provisions.  Headings and captions are used in the Official Rules solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of the Official Rules or any provision hereof.
